Market Forecast Weekly: Kalshi Sues Utah, First-Time Penalty for Insider Trading

This week's forecast market sector is constantly in the news. Kalshi has filed a lawsuit in Utah, asking a federal judge to prevent the state from shutting down its platform—this is the first state without legal sports betting to be sued by Kalshi. Meanwhile, Trump's 1 hour and 47 minutes State of the Union address made a fortune for Polymarket traders who bet on "over 100 minutes." Simply put, the prediction market is fighting lawsuits with various states while earning attention through political event contracts. This week, Kalshi also publicly penalized insider traders for the first time, including a former California gubernatorial candidate and an editor from the MrBeast channel. Want to know the latest regulatory and compliance dynamics of the prediction market? PASA's official website keeps track.

First, Kalshi vs. Utah: Federal and state jurisdiction clash again

This week, Kalshi submitted a 33-page complaint to the federal court, requesting an emergency temporary restraining order against Utah, preventing state authorities from shutting down its platform statewide. This is the first time Kalshi has sued a state without legal sports betting. Utah has always had a strong anti-gambling stance, claiming that Kalshi violates state anti-gambling laws.

Utah Governor Spencer Cox responded last week on the X platform to the CFTC chairman's statement, questioning: "I don't remember the CFTC having jurisdiction over the 'LeBron James rebound derivatives market.'" He vowed to "use all resources to defeat the opponent in court." Kalshi argues that its derivatives are legally offered on CFTC-regulated exchanges, and state government intervention would undermine federal exclusive regulatory authority.

Second, Trump's State of the Union: The longest speech makes Polymarket winners laugh last

Trump's State of the Union address this Tuesday lasted more than 1 hour and 47 minutes, setting a record for at least the last 60 years, nearly 20 minutes longer than Clinton's record in 2000. This result made the Polymarket traders who bet on "over 100 minutes" win.

Before the speech, Connecticut Senator Chris Murphy questioned the contract on the X platform, suggesting it might be manipulated. Data shows that by 5 PM Eastern Time, the implied probability of this option reached 73.5%, a significant increase from 42% 24 hours earlier. Polymarket's order book shows that only four traders held more than 3000 shares betting on this outcome.

Third, Zero Tolerance for Insider Trading: Kalshi's First Public Penalty

Shortly after Trump's speech ended, Kalshi announced penalties against two clients for suspected insider trading:

Kyle Lanford: Former California gubernatorial candidate, bet twice on his own candidacy contract. The Kalshi Disciplinary Committee determined he was a "direct decision-maker" influencing the event outcome. He was fined $2,246.36 and banned for five years.

Arjom Kapur: Editor of the popular YouTube channel MrBeast, used non-public information obtained through his position to bet about $4,000 on platform content contracts, achieving an "almost perfect" trading record. He was banned for two years.

Kalshi's enforcement director stated: "We are committed to rooting out the bad guys, manipulators, and deliberate cheaters." This is the first time Kalshi has publicly disclosed penalties for insider trading.

Fourth, Movements at Fanatics: Former Executive's Job Switch Sparks Acquisition Speculation

Last month, Ali Borod, a former executive at Fanatics, joined Polymarket as President of Sports Business Development, sparking interest. Fanatics initially sued to prevent his job switch, later settling out of court. The lawsuit revealed that since last May, Fanatics has been exploring entering the prediction market, including potential acquisitions of trading platforms. Currently, there are about 24 "designated" exchanges on the CFTC list. A Fanatics spokesperson declined to comment.
