Nevada court issues temporary injunction, Kalshi prediction market suffers another blow.

Nevada's First Judicial District Court recently issued a 14-day temporary restraining order against the prediction market platform Kalshi, prohibiting it from offering event contracts related to sports, elections, and entertainment activities within the state. This move marks a further escalation in the legal battle between Kalshi and the Nevada Gaming Control Board. Simply put, Nevada does not recognize CFTC regulation, only its own gambling laws, effectively shutting Kalshi out.

Judicial showdown: 14-day ban is just the beginning

Although Kalshi is regulated by the CFTC, Nevada considers its services to be equivalent to sports betting, violating state gambling laws. The Gaming Control Board pointed out that Kalshi did not provide consumer protection measures required by state-regulated sports betting. This lawsuit began in March 2025, when state regulators issued a cease and desist letter accusing Kalshi of operating gambling services without a license. Kalshi subsequently sued the NGCB but did not receive a favorable ruling and now faces a temporary restraining order. The chairman of the Gaming Control Board emphasized that Kalshi's claim of operating legally in all 50 states is "clearly false," and the state government will seek a permanent injunction to indefinitely prevent its operation in Nevada.

National crackdown: Criminal charges in Arizona, lawsuits in multiple states

Nevada's restraining order is just one of many legal hurdles Kalshi faces. Earlier this week, the Attorney General of Arizona brought criminal charges against Kalshi for assisting illegal gambling within the state. The outcomes of these cases could set important precedents for the regulation of prediction markets across the US. As prediction markets become increasingly popular, more states may seek to regulate or ban them, especially in the rapidly growing field of sports betting. Kalshi insists that its operations comply with federal law, but Nevada's judicial system is focused on enforcing local gambling laws.

Future outlook: Can prediction markets coexist with traditional gambling?

With the temporary restraining order in effect, Kalshi must reassess its operational strategies within the state and other jurisdictions. Nevada's ruling is part of a broader trend of regulatory agencies strengthening oversight of event betting platforms, also raising a core question: Can prediction markets coexist with the traditional gambling industry under existing legal frameworks? Kalshi's future in Nevada will depend on the final court ruling and whether the company can convince the judge that its services should not be classified as illegal gambling.
