The Kentucky House of Representatives recently passed HB 904 with a vote of 79 to 15, proposing to raise the minimum age for sports betting from 18 to 21, prohibit individual performance betting on state college athletes, and comprehensively regulate prediction markets, fantasy sports, and charitable gambling. Another bill, HB 604, was passed with the same vote count, proposing that online gambling platforms accept bets under $1000, becoming the first in the nation to do so. In essence, it aims to temporarily sideline players aged 18 to 20, add a layer of protection for college athletes, and regulate emerging gambling formats.

Key provisions: Age raised to 21, betting on local college players banned

HB 904 raises the legal age for sports betting from 18 to 21 and prohibits bets on individual performances of Kentucky college athletes. The proposer pointed out that this move aims to eliminate the risk of student athletes being bribed or harassed due to personal performance goals. Although the proposer personally believes that 18 is the age of adulthood, the age limit was raised according to general consensus. The bill also prohibits licensed gambling operators, racetracks, and fantasy sports companies from participating in prediction markets, as it is currently unclear whether the state has the authority to regulate sports-related event contracts.

Operator rules: First in the nation to mandate acceptance of bets under $1000

HB 604 requires online gambling platforms to accept bets under $1000, making it the first in the nation. The amendment allows platforms to refuse bets under certain conditions (such as suspected abnormal activity or accumulated large bets), or to suspend this requirement when a bettor has already placed $5000 in bets in a single day, potentially resulting in over $1 million in payouts. Revenue from prediction markets will be taxed at a 14.25% rate, the same as online sports betting. Opponents worry about hastily changing business practices in an immature market, but the amendment was still passed.

Charitable gambling and community impact: Easing restrictions for nonprofit organizations

HB 904 will also establish clear rules for the long-underregulated charitable gambling industry, allowing nonprofit organizations to expand games at additional venues to raise more funds for their missions. Supporters say the new regulations will strengthen industry accountability and help veteran organizations and other public welfare groups better serve the community. However, opponents warn that this move could encourage the expansion of predatory gambling and even act as a catalyst for the full legalization of gambling.
