The Ministry of Sports published this Tuesday (12) the Ordinance MEsp 109, which regulates measures to promote sports integrity and competition monitoring mechanisms, aiming at the prevention and combat of result manipulation in the context of betting.
Upon receiving a complaint, the MEsp will initiate an internal process and if irregularities are found, it will forward the results to the Treasury, Brazilian Olympic Committee, Sports Justice Tribunals, and the Public Prosecutor's Office.
The Ordinance stipulates that the Ministry may receive information and establish partnerships with operators for the collection of information on rule violations and codes of conduct or other mechanisms aimed at ensuring the integrity of bets in sports events.
Furthermore, within the framework of agreements made by the Ministry of Sports with operating agents, there may be promotion of awareness, education, and training actions, including for athletes, coaches, referees, club professionals, athlete agents, and individuals in governance or administration roles in sports.
The goal aims at strengthening the fight against the manipulation of sports event results, with the development of educational plans that may involve the participation of sports organizations and civil society.
The communication of facts that threaten the fairness in sports should be sent to the Directorate of Integrity in Sports Betting of the National Secretariat of Sports Betting of the Ministry of Finance, preferably presented electronically through the Integrated Platform of Ombudsman and Access to Information – Fala.BR.
The Ministry of Sports, upon preliminary analysis of a complaint, will forward the proceedings to the Ministry of Finance, the Committee for the Defense of Fair Play (COB), the respective Sports Justice Tribunals, and the Public Prosecutor's Office, for knowledge of the facts and adoption of precautionary measures within their respective competencies.
The final result of the investigation that recognizes the existence of a fact that threatens the integrity and unpredictability of the events and sports results, when susceptible to fixed quota betting, will be forwarded to the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance.
For the prevention and combat of betting manipulation, the Ministry of Sports may carry out partnerships with specialized organizations in sports integrity in order to detect, through monitoring systems, suspicious patterns and anomalous behaviors in sports events in the context of sports betting.
