PGR defends the constitutionality of sections of the federal law that impose limits on state lotteries

Six new license applications have been submitted since this Tuesday (17) in the Betting Management System (Sigap). The movement occurred because the government issued an ordinance prohibiting bets without a request from operating after October 1st. Companies that had already registered in the first deadline will have a response by the end of November to operate definitively from January 1, 2025.

Since this Tuesday, the Betting Management System (Sigap) has received six more requests for authorization to operate sports betting and online games. The Secretariat of Prizes and Bets (SPA) thus has 119 processes to analyze, with the initial 113, as committed by the SPA, to be addressed by the end of November so that the companies can operate definitively from January 1 of the next year.

In a movement already expected by the government, which issued an ordinance determining that companies without a request for authorization are prohibited from operating from October 1st, four new applications were presented and it is expected that new requests will be presented in the coming days.

The new companies that presented themselves to Sigap are:

– BRX Gaming S.A

– Amplexus Corporation Ltda

– Nexus International Ltda

– JBD Communication and Technology Ltda

– Good Luck Prizes Ltda

– Wudy Pay Financial Institution Correspondent Ltda

None of them are guaranteed that their requests will be analyzed this year, but at least they will be able to continue operating, if they are already doing so, after October 1st. If they are not yet offering sports betting and online games, they will have to wait for definitive authorization.

The priority in the analysis of requests by the Secretariat of Prizes and Bets will be for companies that met the first request window, until August 20th.

The Attorney General of the Republic, Paulo Gonet, sent an opinion to the Supreme Federal Court this Tuesday (17) defending the constitutionality of sections included in Law 13.756 that restrict the participation of companies in state and Federal District lottery services and regulate the advertising of the activity. According to him, the limits fall within the competence of the Union to regulate the lottery system, the promotion, and the planning of the activity.

In addition, the norms are in accordance with the constitutional principles of equality and consumer protection, in the assessment of the Attorney General.

The statement was in the Direct Action of Unconstitutionality (ADI) 7640, proposed by the states of São Paulo, Minas Gerais, Paraná, Acre, Mato Grosso do Sul, Rio de Janeiro, and the Federal District.

They question the validity of paragraphs 2 and 4 of article 35-A, included in the federal norm that regulates state lotteries. The provisions establish that the same economic group or legal entity can only explore the service, through concession, in a single federal unit. In addition, they prevent a lottery from one federal unit from advertising in another.

What the PGR says

In the opinion, Paulo Gonet counters the arguments presented by the authors and defends that the request made in ADI 7640 be denied by the STF. For him, the Union has exclusive competence to legislate on consortium and lottery systems in Brazil, allowing state members to explore public lottery services within the limits established by federal law.

In this context, by preventing the participation of the same economic group in lottery services from different states, Law 13.756/2018 seeks to prevent the concentration of private economic power in a sector that tends to be sensitive to the economy.

The restriction established by the federal law tends to promote a market more open to economic agents, in more intense competition”, argues Paulo Gonet. According to him, market "deconcentration" measures foster the interest of new agents to compete.

Regarding the limitation of advertising for these services, the PGR defends that the legislation seeks to prevent states with more resources and greater advertising capacity from disproportionately attracting a larger volume of bettors from other federal units.

Having constitutional support for the geographical restriction of the exploration of lotteries, the geographical limitation to the respective advertising is equally admitted”, he concludes.
