Concerned about clarifying for users of betting houses accredited by Loterj regarding the continuity of service provision in light of the list of bets authorized by the Ministry of Finance, the agency issued a note on the subject. The court's position in favor of the company allows its licensees to continue operating throughout Brazil according to the rules of Rio de Janeiro.
In addition to the list published by the Secretariat of Prizes and Bets of the Ministry of Finance, the fixed quota betting sites accredited with Loterj will be able to continue operating throughout Brazil.
Loterj regulated in April 2023, based on what the Supreme Federal Court (STF) decided in ADPF 492, and in Paragraph 8 of Article 35-A of Law 14.790/2024, which secures Loterj's position.
On this topic, the Federal Regional Court (TRF1) granted an injunction to Loterj, emphasizing that the Ministry of Finance's ordinances on the subject invaded the regulatory competence of the states and exceeded federal competence, as established by the Federal Constitution and by the STF itself.
Since June last year, various bets have been accredited by Loterj to operate after participating in the Accreditation Notice, paying a concession fee of R$ 5 million for a period of up to five years of exploitation and bearing the federal taxes and fees monthly to the Union.
