The state government of São Paulo promoted an auction this Friday (1st) for the dispute of the state lottery service concession. For R$ 600 million, the Winning Bet consortium, led by the Portuguese SAV Participações, will be able to explore the lottery service physically or virtually, in the modalities of prognostics (such as sports betting) and instant lottery (such as scratch cards) for the next 15 years.
The European consortium won the concession in a heated dispute, with an offer of R$ 600 million, corresponding to 130.15% above the minimum bid established, of R$ 260.7 million.
The group defeated the SP Loterias Consortium, led by IGT Global Services Limited, an Italian group listed on the New York Stock Exchange, which already operates the state lottery of Minas Gerais.
The lottery is expected to generate R$ 3.4 billion in revenue for the state government over the next 15 years. According to the Secretary of Partnerships and Investments of the state, Rafael Benini, the government will keep 35% of the gross operational revenue throughout the concession. The money raised will necessarily be reverted to public health.
The governor of the state, Tarcísio de Freitas, stated that all the grant value will go to two hospitals in the interior of the state. “Besides the fixed grant, we become partners in the business and start to earn part of the revenue. The more you [winners] perform, the more the state gains. And the forecast is a gain of R$ 3.4 billion over the period of the contract”, Tarcísio commented.
The dispute already started with high premiums. The first offer from the SP Loterias Consortium was 86.63% higher than the minimum bid set by the government. The Winning Bet, which later became the winner, started behind, with a premium of 78.36%, but managed to reverse during the live-voice dispute - a modality in which offers are made verbally.
The project establishes 31 exclusive units and more than 11,000 non-exclusive points for the lottery outlets throughout the Paulista territory.
Control mechanisms
The concession of the SP State Lottery requires the development of a compliance plan for preventing money laundering and other misconduct in betting. It also foresees control mechanisms. Among them, a form of self-exclusion for users.
"This means that, if a person informs on the website that they do not want to play for 30 days, the portal will be blocked for the profile during this period", explains the president of the Paulista Company of Partnerships (CPP), Edgard Benozatti Neto.
Rights of the winning consortium and vice
The Winning Bet will be able to explore the service physically or virtually. The company will not be obligated to offer all game modalities because it will have to assume the responsibilities and risks of the business, according to the contract parameters.
Two game modalities have been defined: the instant ones and the prognostics. In the instant ones, the bettor knows the result immediately, like the scratch card, when the bettor just checks the predetermined result.
The prognostics modality is divided into four systems: specific, numeric, sports, and passive. In the specific and numeric, the bettor chooses and hopes to hit the largest number of
numbers drawn, like in Mega-Sena.
The sports modality is made in relation to bets on football games, like the famous “pools”. As the prize is distributed among the winners, the amount received will be greater if the bettor chooses a result with fewer adherences.
Bets are not included in the package. The same happens with modalities not regulated or prohibited by law, such as casino and bingo.
Rules and obligations
The concessionaire must follow betting laws, such as preventing minors from playing, keeping physical sales at a distance of at least 300 meters from schools, and also creating advertising materials about the risk of addiction to games. The supervision will be in charge of Arsesp (Regulatory Agency for Public Services of São Paulo).
The contract also provides that the company prevents the acquisition of products by children and adolescents and presents programs for protection and assistance to people vulnerable to games and their families. The physical sales points must be at a distance of at least 300 meters from daycare centers or basic and elementary education units.
The concession was only possible because the STF revoked the law that allowed only the federal government to explore this type of game. In 2020, the Supreme Court decided that states could have their own lotteries. In São Paulo, the system was approved in 2022 by the Legislative Assembly.
The contest is part of the "marathon" of auctions promoted by the government of São Paulo until the end of the year, which aims to attract investments of about R$ 20 billion. The first batch of schools (on Tuesday) and the Sorocabana Route (on Wednesday) have already been granted. The dispute for the road concession of Nova Raposo, on November 28, will close the agenda.

Available betting modalities
The concessionaire will be able to offer the modalities of prognostics (specific, sports, numeric, and passive) and instant, in physical and virtual environments.
The games will be prohibited for minors under 18 years and will be restricted to the modalities provided in the contract. The so-called bets (fixed quota bets), as well as modalities not regulated or prohibited by law, such as bingo, casino, slot machines, and jogo do bicho, are not included.
In the specific and numeric prognostics modalities, the bettor chooses and tries to hit the numbers drawn in a contest. The numeric prognostic bet should be similar to the games of Caixa Econômica Federal, such as Mega-Sena, Quina, Lotomania, Lotofácil, and others.
In the sports modalities, the bettor tries to predict the outcome of a sports event, such as football, similar to Loteca from Caixa.
In the sports modality, until the start of the game, the person can bet on the victory, defeat, or draw of the teams. When the contest is closed, the lottery house will have a view of the total collected in the bets. Assuming that 80% of the guesses were for team “X” and 20% for “Y”, there will be a prior probability of redistribution of winnings among the winners.
The instant lotteries must immediately show whether the participant was awarded any prize, like the scratch card. The concessionaire will define in advance a numerical sequence with the awarded numbers and values.
The passive lottery is also a numeric prognostic game, like Mega-Sena. However, instead of selecting the numbers, the bettor will buy a pre-filled ticket. In a future and pre-determined draw, he discovers if the ticket was awarded.
Responsibilities of the concessionaire
The future concessionaire will be able to explore lotteric products similar to those already authorized, both physically and virtually, without the obligation to offer all services. In addition, the company will assume the risks associated with the contests. The Regulatory Agency for Public Services of SP (Arsesp) will be responsible for supervising the concessionaire's performance.
The state model of lotteries was released by the Supreme Federal Court (STF) in 2020, after a decision that the Union could not monopolize the service. The creation of a state lottery was approved in 2021 by the Legislative Assembly of São Paulo.
Last week, the minister of the STF, Luiz Fux, suspended part of the Sports Betting Law that prohibited the advertising of lotteries in more than one state. The decision was a preliminary injunction from the government of São Paulo, defending that the states have the right to explore public lottery services without discrimination by the Union.
